CADDY FOR A CURE, INC.
PARTICIPATION REQUIREMENTS
AND
TERMS AND CONDITIONS


As a prerequisite to participation with and in conformity with the rules governing Caddy For A Cure, I hereby consent to the following:

1. A criminal background check.

2. Consent to Release and Indemnity Agreement as outlined in Attachment A.

3. Caddy For A Cure reserves the exclusive right at its sole discretion to terminate the Caddy Privilege if said Terms and Conditions are violated or for cause to maintain the safety and integrity of the program for all parties.

4. No relationship exists or is established between the participant, the Tour Player, the PGA Tour, any sponsors or affiliates of the Tournament or any charities affiliated with Caddy For A Cure as a result of this Caddy Privilege.

5. No solicitation, advertising or promotion of any kind, nor use of the Tour Player, PGA Tour, sponsors or affiliates of the Tournament or affiliated charities' images or logos is permitted before, during or after the Caddy Privilege from the program participant.

6. All rights and privileges associated with any activity involving Caddy For A Cure remain the exclusive property of Caddy For A Cure and may not be used for any private purposes without the prior written consent of Caddy For A Cure.

7. Consent to all Terms and Conditions as outlined in Attachment B.







ATTACHMENT A
RELEASE AND INDEMNITY AGREEMENT


This Agreement is entered into this _____ day of _______________, 2008 between _________________________ (hereinafter called "Caddy") and Caddy For A Cure, Inc. and is subject to the terms of the Participation Requirements and Terms and Conditions as well as Terms and Conditions of Attachment B and is binding on all servants, successors, parents, subsidiaries, agents and employees of said Caddy.

For and in exchange for the privilege and opportunity to perform as a caddy for a participating professional golfer during a designated event practice round, Caddy will indemnify and forever hold harmless and defend Caddy For A Cure, Inc., Russ Holden, Colleen Holden, the PGA TOUR, the individual professional golfer and the Caddy For A Cure, Inc. website developer against any loss from any and all claims, demands, actions, in law or in equity, that may hereinafter at any time be brought by Caddy or any person or entity making claims by, through or on behalf of said Caddy.

This Agreement to indemnify specifically applies to any claims, lawsuits, counterclaims, cross-actions, cross-claims, subrogation claims, interventions which could have been brought on behalf of said Caddy.

This Agreement to indemnify is also meant to include any and all claims or causes of action that may, or could have been filed, by any immediate family member including the spouse, children or parents of Caddy concerning any incident that may occur while participating in Caddy For A Cure, Inc. events, projects or promotions.

In the event that one or more of the provisions, or portions thereof, of this Agreement is determined to be illegal or unenforceable, the remainder of the Agreement shall not be affected thereby and each remaining provision or portion thereof shall continue to be valid and effective and shall be enforceable to the fullest extent permitted by law.

This Agreement shall be construed and interpreted in accordance wit the laws of the State of Florida.

Caddy further states that the foregoing Release and Indemnity Agreement has been carefully read and Caddy knows the contents thereof and has signed the same as Caddy's own free act and has not been influenced in making this Agreement by any representation of the part or parties released and indemnified.

ATTACHMENT B
TERMS AND CONDITIONS


1. Payment in full in U.S. Dollars is required prior to participation in event and within 24-hours of close of auction. All payments must be made according to the methods outlined in the Caddy For A Cure auction.

2. In the event cause is determined for terminating the Caddy Privilege, all monies paid by participant are nonrefundable.

3. In the event winning bidder is unable to participate in designated event for personal reasons, the Caddy Privilege may be gifted to another participant with prior approval of Caddy For A Cure. All terms and conditions must be met by new participant prior to the designated event and all rules to participation still apply.

4. Winning participants will wear Caddy For A Cure golf shirts as provided by program administration. No other sponsor logos are allowed on apparel worn or accessories used by program participants. Traditional golf Brand caps, visors or other headwear are acceptable.

5. Any expenses incurred or necessary for winning bidder to participate in the Caddy Privilege are the responsibility of the participant. These expenses may include, but are not limited to, travel to and from event, accommodations at the event or meals and entertainment expenses.

6. Participant agrees to comply with all schedules provided by Caddy For A Cure management as they relate to participation in the specific tournament and for the designated Tour Player. These schedules will be provided to participant no less than one day prior to the practice round.

7. In the event Tour Player is unable to participate in, or withdraws from, designated event, Winning participant will be offered several options as determined by Caddy For A Cure: 1) An alternate Tour Player; 2) An alternate event; 3) A refund.

8. In the event an Act of God, as determined by the PGA TOUR, prevents the execution of the designated Practice Round, several options as determined by Caddy For A Cure will be offered: 1) An alternate Tour Player; 2) An alternate event; 3) A refund.

In all cases, Winning Participant may elect to contribute an amount above the winning bid amount paid or may donate winning bid amount to Caddy For A Cure without participating in the designated event.
